Roundup Class Action Over False Advertising

In April 2015, a Roundup class action lawsuit (PDF) was filed in Los Angeles, California in (Case No. BC-578-942). Monsanto claims Roundup is safe because it targets an enzyme that is found in plants, but not people. Lawyers say this claim is “blatantly false” and misleading. Roundup targets the enzyme EPSP synthase, which is found in weeds, plants, bacteria, fungi, algae, and other microbes. In the human digestive system, over 100 trillion bacteria produce EPSP synthase.

Roundup Lawsuits Filed by Cancer Victims

Roundup Lawsuits Centralized in California

In October 2016, federal judges established a Multi-District Litigation (MDL No. 2741) to centralize dozens of Roundup lawsuits in the Northern District of California. Lawyers accuse Monsanto of failing to warn about non-Hodgkin lymphoma. They also say Roundup contains a toxic combination of glyphosate with the chemical POEA, which is more dangerous than glyphosate alone.

What is the problem?

The Clark Firm, LLP is nationally recognized as a class action law firm in Texas. However, our trial lawyers are not currently filing a Roundup class action against Monsanto. Instead, we are filing individual lawsuits on behalf of people who were diagnosed with cancer, such as:

About Class Actions

Class actions are the most popular way for large groups of people to seek justice for the same legal claim. Good examples include refunds for defective products or compensation for discrimination and fraud. Members join together and share any payout.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

The problem with class actions is that they can have major disadvantages for individuals with severe injuries. It is extremely rare for consumer class actions to go to trial, which means most cases never go before a judge or jury. Another problem is that members may have to accept “low-ball” settlements or higher attorneys’ fees.

Instead of a class action, our lawyers provide personal legal representation for people who were severely injured by dangerous medications. We specialize in holding companies accountable for failing to warn about side effects. If you decide to join this rapidly-growing litigation, you could receive compensation for your pain and suffering, medical expenses, and more.
