October 4, 2016 — A panel of federal judges has centralized dozens of Roundup lawsuits in a Multi-District Litigation (MDL No. 2741) in the U.S. District Court for the Northern District of California.
According to the transfer order (PDF), there are 37 lawsuits pending in 21 district courts nationwide. At least 10 law firms represent people who developed lymphoma after several years of exposure to Roundup.
All of the lawsuits allege that Roundup, a widely-used glyphosate-based herbicide, can cause non-Hodgkin lymphoma and that Monsanto failed to warn consumers about the risk.
The lawsuits also allege that the use of glyphosate in conjunction with other ingredients — in particular the surfactant POEA — makes Roundup even more toxic than glyphosate on its own.
The Northern District of California was chosen because it is where two of the earliest-filed and most advanced lawsuits are pending. The litigation will be overseen by U.S. District Judge Vince Chhabria, who has not yet had the opportunity to preside over an MDL.
Centralizing the lawsuits in one court streamlines the process and hopefully brings a faster legal remedy to people who were injured. It also prevents inconsistent rulings and eliminates duplicative discovery.
