Although The Clark Firm, LLP is nationally recognized as a class action law firm, we are not currently pursuing justice for our clients through a Propecia class action lawsuit. However, we are currently reviewing cases for individual Propecia lawsuits for inclusion in several centralized litigations.

Your Propecia lawsuit could be awarded compensation for:

  • Pain and suffering
  • Medical expenses
  • Lost income
  • Decreased quality of life
  • Loss of consortium with spouse
  • Punitive damages
  • And more

What is the problem with class action lawsuits?

In the United States, class action lawsuits are not usually used to resolve large, complex pharmaceutical drug litigation. Instead, individual lawsuits are centralized in Multi-District Litigation (MDL), which is often erroneously referred to as a “class action lawsuit.”

The biggest difference between a Propecia class action lawsuit and the Propecia MDL is that individual plaintiffs file individual lawsuits in an MDL, instead of having their claim consolidated with other claims. Furthermore, plaintiffs retain their own legal counsel to argue for compensation. If compensation is awarded, the plaintiff is not forced to share it with other plaintiffs in the class action lawsuit.

Propecia Lawsuits Centralized in Federal Litigation

On April 16, 2012, the U.S. Judicial Panel on Multi-District Litigation (JPML) centralized Propecia lawsuits before Judge John Gleeson in the U.S. District Court for the Eastern District of New York. Within one year, hundreds of Propecia lawsuits were filed in the MDL. All of the lawsuits allege that Merck & Co. failed to adequately warn that side effects of Propecia could cause permanent sexual dysfunction and other side effects.

In addition to the federal litigation, a number of lawsuits have been centralized in a New Jersey Superior Court Propecia Litigation before Judge Jessica R. Mayer in Middlesex County.
