NeocateNeocate baby formula does not contain Phosphates, Potassium and other essential nutrients for proper bone development. As a result, a growing number of babies have suffered unexplained bone fractures and other serious side effects.

Need a Texas Neocate Class Action Lawyer? Collen A. Clark is a true advocate for his clients and is passionate about helping Texans that have been injured or wronged. If your child suffered broken bones, fractures, or rickets after using Neocate formula, you should contact our lawyers immediately. You may be entitled to compensation by filing a lawsuit.

What is Neocate?

Neocate® is an amino-acid-based baby formula, also known as an “elemental formula.” It is advertised for use in babies with severe food allergies to soy, cow’s milk, and other foods.

Parent of Neocate-Fed Baby Accused of Child Abuse

At least one parent was accused of child abuse after his son developed multiple unexplained bone fractures. The boy had cerebral palsy and was confined to a wheelchair. The CPS case was only closed after the father saw an attorney’s TV ad linking Neocate and bone fractures.

Neocate and Bone Fractures

Neocate lacks some of the essential nutrients that a baby needs to develop strong healthy bones. Babies who do not get enough phosphate, for example, are significantly more likely to suffer bone fractures, rickets, and weak bones as a result of poor mineralization.

Study Finds Bone Development Problems in 94% of Babies Fed Neocate

In April 2017, the Bone Journal published a study of 51 children who had low phosphate levels (hypophosphatemia) after being fed a diet solely consisting of Neocate. Of those children, 94% also had rickets, bone fractures, or under-mineralization of the bones, according to the researchers.

What is the problem?

The Clark Firm, LLP is nationally recognized as a class action law firm in Texas, but our lawyers are not filing a Neocate class action lawsuit. Instead, we are filing individual lawsuits for babies who developed severe bone problems after being fed Neocate, such as:

  • Unexplained bone fractures
  • Broken bones
  • Rickets
  • Low phosphate levels
  • Hypophosphatemia
  • Under-mineralization of the bones
  • Bone development problems
  • Disfigurement
  • Misdiagnosis of child abuse

About Class Actions

Class actions typically involve a large group of people who are seeking a relatively minor payout, such as a refund. Everyone in the class action shares the payout. Unfortunately, this can have disadvantages when individuals have far more serious injuries than the average person who joins the class action lawsuit.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

There is no excuse for companies who sell a product that causes severe injuries or permanent disfigurement to babies and children. Instead of a class action lawsuit, our lawyers are filing individual Neocate lawsuits so we can focus on seeking compensation for pain and suffering, medical expenses, future care, disability, and more.
