After a deadly outbreak of liver damage, Hydroxycut was recalled. Several class actions were filed immediately for false advertising. Recently, the manufacturers agreed to a $14 million class action lawsuit settlement.

Hydroxycut Class Action Lawsuits
Iovate Health Sciences and MuscleTech were hit with several class action lawsuits soon after Hydroxycut was recalled in May 2009 due to an outbreak of liver damage. At least 23 people were injured, including one who died. One person also needed a liver transplant.
The class actions were filed in federal court in Massachusetts and Alabama. In June 2010, about 40 lawsuits and class actions were centralized in a Multi-District Litigation (MDL) in the U.S. District Court for the Southern District of California. The class actions accused Iovate of false advertising for marketing Hydroxycut as safe when they knew it was not.
Iovate offered to settle the class actions for $25.3 million in November 2012. However, the judge overseeing the litigation rejected the settlement. In April 2014, the class action settled for $14 million.
What is the problem?
The Clark Firm, LLP is nationally recognized as a class action law firm, but our attorneys are not filing a Hydroxycut class action at this time. Class actions have already been filed, but they focused on violations of state laws against false-advertising claims.
Our attorneys focus on legal representation for people with severe liver damage caused by Hydroxycut. We are investigating cases involving:
- Jaundice (yellowing of skin and eyes)
- Elevated liver enzymes
- Liver damage
- Hepatic encephalopathy
- Cirrhosis (scarring)
- Liver failure
- Liver transplant
About Class Actions
When a large number of people have the same legal claim, class actions are a great way for everyone to seek compensation without filing hundreds of lawsuits. Many class actions are filed by one person on behalf of thousands of people or the general public. If compensation is awarded, lawyers take a percentage and the rest is divided among everyone who opts in to the settlement.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Hydroxycut Class Action
Liver failure is a devastating disease that often destroys a person’s health and livelihood, costs tens of thousands of dollars, and weeks or months of hospitalization. Many people who are waiting for a liver transplant die before they receive an organ because the waiting list is so long.
Our attorneys file individual lawsuits because we believe victims of Hydroxycut deserve a legal representative who is committed to their case. If you decide to file a lawsuit, you could receive compensation for your pain and suffering, medical expenses, lost income, disability, decreased quality of life, and more.
