Hydroxycut Class Action Lawsuits

Iovate Health Sciences and MuscleTech were hit with several class action lawsuits soon after Hydroxycut was recalled in May 2009 due to an outbreak of liver damage. At least 23 people were injured, including one who died. One person also needed a liver transplant.

The class actions were filed in federal court in Massachusetts and Alabama. In June 2010, about 40 lawsuits and class actions were centralized in a Multi-District Litigation (MDL) in the U.S. District Court for the Southern District of California. The class actions accused Iovate of false advertising for marketing Hydroxycut as safe when they knew it was not.

Iovate offered to settle the class actions for $25.3 million in November 2012. However, the judge overseeing the litigation rejected the settlement. In April 2014, the class action settled for $14 million.

What is the problem?
