In August 2024, Boar’s Head Provisions was hit with a proposed consumer class action lawsuit in New York federal court, filed the day after 7.2 million pounds of deli meat products were recalled nationwide due to Listeria contamination.

10 Deaths, 59 Hospitalizations Linked to Boar’s Head Deli Meats

Since the recall, Boar’s Head deli meat products have been linked to at least 10 deaths and 59 hospitalizations in 19 states between June and September 2024, according to the CDC. The true number of sick people is likely much higher. It can take up to 10 weeks for the symptoms of Listeria to appear.

Who Filed The Class Action Lawsuit?

The lawsuit was filed by a woman who bought Boar’s Head Ham from her local Shop Rite store in Queens County, New York. She paid about $11.54 for the ham, but claims that the deli meat products were “actually worthless because they possibly contained Listeria.”

She accuses Boar’s Head Provisions of “deceptive and misleading business practices” by failing to warn consumers that “the products are contaminated with Listeria monocytogenes.”

She also claims that the recall remedy from Boar’s Head is insufficient because consumers must keep the recalled deli meat products and return them to the store where they were purchased to get a refund.

The class action lawsuit was filed on August 1, 2024 in the U.S. District Court for the Eastern District of New York — Case 1:24-cv-05405.
