The MDL is located in the U.S. District Court for the Southern District of California (San Diego) under U.S. District Judge Jinsook Ohta: IN RE: AngioDynamics, Inc., and Navilyst Medical, Inc., Port Catheter Products Liability Litigation.

How Many Lawsuits Have Been Filed?

When the MDL was established, there were about 90 lawsuits filed in state courts nationwide against AngioDynamics and Navilyst Medical.

Those lawsuits (along with future lawsuits) will be transferred to the MDL in California. All of the lawsuits share important factual questions, so judges consolidated the litigation in a MDL because it is more efficient and cost-effective than having lawsuits spread out nationwide.

What Do Lawsuits Allege?

AngioDynamics and Navilyst are accused of failing to warn the public about potential safety risks from port catheter devices, and failing to recall devices that they knew (or should have known) were unsafe.

Port Catheter Lawsuits Claim Catheter is Defective

Lawsuits specifically claim that the catheter is defective because it was manufactured with an “excessive concentration of barium sulfate, causing the material to degrade and the surface of the catheter to pit or crack. As a result, plaintiffs contend, the catheters are prone to fracture and to collect fibrinous blood products, which causes perforation, infections, and blood clots, among other injuries.”

What Are Port Catheters?

AngioDynamics manufactures a variety of implantable port catheters. These devices are used for long-term venous access. They allow patients to avoid repeated needle-sticks for medical treatments like chemotherapy, blood draws, IV fluids, blood transfusions, and more.

Implantable port catheter devices are also called Totally Implanted Venous Access Devices (TIVAD). They are implanted completely inside the patient’s body, with a port just under the patient’s skin where the needle is injected, and a long flexible tube called a catheter that delivers fluids to a large vein.
