March 29, 2019 — One day after a California jury awarded $80 million to a man with cancer who used Roundup, a third trial has begun in the case of a married couple who both developed lymphoma after using Roundup to kill weeds for about 35 years.
Law360 reports that another jury in Oakland, California has heard opening arguments from lawyers who allege that Monsanto failed to warn Alva and Alberta Pilliod about the potential risk of developing cancer from using Roundup.
The Pilliod couple, now both in their 70s, started using Roundup to control weeds on their 4 properties between the 1980s and 2017, when Alva saw a commercial linking Roundup with lymphoma.
Alva was diagnosed with aggressive diffuse large B-cell lymphoma in 2011. His wife was diagnosed with the same rare cancer in 2015. Both of them have undergone chemotherapy and other treatments which caused “chemo brain” and other debilitating long-term side effects.
A doctor for the couple concluded that their diseases must have been caused by something in their environment because it is so unusual that the couple both developed the same rare cancer within 4 years.
Lawyers for the couple repeated much of the same evidence that led another California jury to award $80 million on behalf of Edwin Hardeman, a man who developed lymphoma after decades of using Roundup to control weeds on his 56-acre property in Santa Rosa.
Lawyers for the Pilliods also presented new evidence. For example, in 2015, the California EPA determined that glyphosate is a carcinogen.
