September 27, 2016 — A federal judge in Dallas has rejected a request from the Justice Department to shut down SK Laboratories, Inc., the company that helped make OxyElite Pro.
SK Laboratories was a manufacturer contracted by USPLabs, according to The Dallas Morning News.
USPLabs imported raw ingredients from China and shipped them to SK Laboratories, where they were encapsulated and bottled into the finished product, and then shipped to a USPLabs facility in Dallas.
SK Laboratories and its 33 year-old vice president Sitesh Patel were criminally indicted by the Justice Department in November 2015 for its role in OxyElite Pro. Patel was indicted again in July 2016 for importing illegal steroids from China and selling them as dietary supplements.
The Justice Department asked U.S. Magistrate Judge Paul Stickney to shut down SK Laboratories, warning that repeated fraudulent activities make them “a menace to the health of American consumers.”
On September 20, Judge Stickney refused to shut down SK Laboratories because he had no evidence proving that SK Laboratories was currently violating the law.
According to the Justice Department, USPLabs was introduced the illegal stimulant DMAA by Sitesh Patel and SK Laboratories. The companies manufactured OxyElite Pro and Jack3D, which generated over $400 million in sales. After reports of cardiac arrest and other adverse events, the FDA cracked down on DMAA in 2013.
The companies re-formulated OxyElite Pro with another illegal ingredient called aegeline. It was soon linked to an outbreak of non-viral hepatitis (liver inflammation) that injured 72 people. Of those victims, 47 were hospitalized, 3 required a liver transplant, and a mother with seven children died.
