January 2014 — Plaintiff Sardeep Bardot filed an OxyElite Pro class action lawsuit in New Jersey. The class action is putative, meaning that it does not seek to represent plaintiffs who were injured — rather, Bardot alleges that he never would have purchased OxyElite Pro if USPLabs and GNC had warned him about the health hazards of DMAA and aegeline. $2 Million Settlement in OxyElite Pro Class Action

In February 2013, the New York Times reported that a class action lawsuit involving OxyElite Pro and Jack3D was settled for $2 million. Consumers were eligible for up to $300 in compensation for products purchased within a certain time frame.

The class action consolidated multiple false-advertising claims that were filed in California. Under terms of the settlement, USPLabs agreed to remove DMAA from the ingredients, place more prominent warnings on the label, and stop making false or misleading statements.
