$2 Million Settlement in OxyElite Pro Class Action
In February 2013, the New York Times reported that a class action lawsuit involving OxyElite Pro and Jack3D was settled for $2 million. Consumers were eligible for up to $300 in compensation for products purchased within a certain time frame.
The class action consolidated multiple false-advertising claims that were filed in California. Under terms of the settlement, USPLabs agreed to remove DMAA from the ingredients, place more prominent warnings on the label, and stop making false or misleading statements.

About Class Actions
When many plaintiffs join a class action, each individual claim is consolidated with other claims into one lawsuit. One member of the class is chosen to represent the entire group. That representative’s name goes on the case, and their lawsuit can potentially go to trial. If the case is successful, the financial award is divided among other members of a class action.
