November 22, 2013 — USPLabs, LLC, has been hit with several OxyElite Pro lawsuits. One lawsuit was filed by a 22 year-old man from Kailua-Kona, Hawaii, who developed liver problems in August, one month after starting OxyElite Pro.
Kenneth Waikki thought he had food poisoning, but his mother became concerned when she noticed he had jaundice (yellowing of the whites of the eyes). Soon after, he fell into a coma and suffered liver failure. Miraculously, he was chosen to receive a liver transplant on September 30, saving his life. Today, he must take medications and restrict his exercise.
Another lawsuit was filed by a woman from Keaau, Hawaii in federal court in Hawaii on November 19. The plaintiff, Everine Van Houton, 33, used OxyElite Pro for one month before developing symptoms of liver damage — abdominal pain, fatigue, and nausea. She was diagnosed with acute hepatitis (sudden liver inflammation) and learned about the link to OxyElite Pro from public health alerts.
The lawsuit was also filed against GNC Holdings Inc., the store where Van Houton purchased OxyElite Pro. In October, Hawaiian health officials ordered GNC to remove OxyElite Pro from all 25 stores in the state. Unfortunately, every local GNC manager visited by the Hawaii Department of Health said they would not remove OxyElite Pro from shelves. State officials in Hawaii embargoed shipments of OxyElite Pro onto the island. Under pressure, GNC finally agreed to remove OxyElite Pro in Hawaii, but not on the mainland United States.
OxyElite Pro was not taken off store shelves nationwide until the U.S. Food and Drug Administration (FDA) threatened USPLabs with enforcement action unless they issued a recall. USPLabs recalled OxyElite Pro on November 10. On November 19, the recall was expanded to include Raspberry Lemonade OxyElite Pro Super Thermo Powder.
