April 3, 2017 — The family of a man from North Carolina who died of complications from an IVC filter has filed a lawsuit against the manufacturer, B. Braun Medical Inc.
The lawsuit (PDF) was filed on March 31, 2017 in federal court in Charlotte, North Carolina against B. Braun Medical and Aesculap Implant Systems — Case No. 5:17-cv-00061.
The case involves Keith A. Waters, a man who died of complications related to the VenaTech™ LP Permanent Inferior Vena Cava Filter.
The filter was implanted in his body on March 12, 2015 at Catawba Valley Medical Center in North Carolina. After implantation, it malfunctioned and caused injury to surrounding tissues, blood vessels, and organs, The Morning Call reports.
The fractured pieces of the broken VenaTech IVC filter traveled in his bloodstream and migrated to his lungs and heart. This caused blood clots to form above the filter, resulting in his death from cardiac arrest. According to the lawsuit:
“On or about April 2, 2015, decedent died from complications related to the defective IVC filter, including but not limited to, filter thrombosis, multiple pulmonary emboli, and cardiac arrest.”
The lawsuit was filed by his wife, Lorraine Waters, who is seeking compensation for mental pain and suffering and loss of consortium.
Lawyers say VenaTech was defective and unsafe because it was dangerous for its intended purpose and caused severe injuries when used for such purposes. Furthermore, B. Braun and Aesculap are accused of downplaying side effects and failing to test it for safety.
The most severe IVC filters injuries include death, hemorrhage, cardiac or pericardial tamponade (pressure due to blood accumulating in the space around the heart), cardiac arrhythmia and other heart attack-like symptoms, perforations, chronic Deep Vein Thrombosis (DVT), pulmonary embolism, compartment syndrome, and more.
