Argon Medical Devices manufactures the Option™ ELITE Retrievable Vena Cava Filter. It is implanted in the inferior vena cava (IVC) to catch blood clots before they get into the lungs. It was created by Rex Medical for the prevention of recurrent pulmonary embolism.

Argon IVC Filter Lawsuits Filed in Texas

In August 2016, a lawsuit (PDF) was filed against Argon Medical Devices in Dallas County Circuit Court by a man who has an Option IVC filter permanently embedded in his body. The filter perforated his vena cava and cannot be removed without causing worse health problems.

In October 2016, another lawsuit (PDF) was filed in Texas by a woman who has an Option IVC filter permanently embedded in her body. The filter also caused blood clots, chronic pain, and circulation problems. According to the lawsuit:

“As long as the Option filter remains embedded in her vena cava, Plaintiff is at risk for further thrombosis and future filter fractures, migrations and perforations and tilting. She faces numerous health risks, including the risk of death.”

1st Clinical Trial Currently Underway

The Option ELITE has been on the market since 2014, but it was not studied in clinical trials before it was approved. Argon Medical Devices is currently participating in the PRESERVE clinical trial, the first large-scale study of IVC filters. The 5-year study began in December 2015 and it will enroll 2,100 patients for 7 devices, with 300 receiving the Option ELITE.

FDA Safety Warning for Temporary IVC Filters

In August 2010, the FDA issued a Safety Warning after nearly 1,000 patients experienced severe side effects from IVC filters. The FDA now recommends removing temporary IVC filters within 29-54 days, or as soon as possible — when the risk of blood clots subsides, or the patient can safely take a blood-thinning medication instead.

Retrieval Rates Remain Low

Unfortunately, studies have found that retrieval rates for temporary IVC filters remain very low. In general, only about 20% of IVC filters are ever removed. Less than 10% are removed from trauma patients.

Temporary vs. Permanent IVC Filters

Temporary IVC filters are not designed for permanent placement. The FDA approved them without requiring new clinical trials because they were “equivalent” to permanent filters. The difference is that temporary filters are often weaker than permanent filters. This adds flexibility and makes it easier to remove, but increases safety risks the longer it remains implanted in the body.

IVC Filter Complications

The vena cava is the largest vein in the body, but it has remarkably thin walls. Perforation is one of the most common complications of IVC filters. Patients may not have symptoms, but the filter will be harder to remove and it may not work. The needle-like legs of an IVC filter can also break off, travel in the bloodstream, and get stuck in the heart or another vital organ.
