May 28, 2015 — Boston Scientific has been ordered to pay $100 million to a woman who was injured by the company’s vaginal mesh, the largest-ever jury verdict in the litigation.
Bloomberg reports that a state-court jury in Delaware found Boston Scientific liable for 51 year-old Deborah Barbra’s injuries from the company’s Pinnacle and Advantage Fit implants.
Barbra said the devices were made of substandard material that shrank and eroded into her vagina, leaving her in constant pain, unable to have sex, scarred, and with other medical problems.
The jury found that Boston Scientific engaged in fraud by failing to warn doctors about design defects, awarding $25 million in compensatory damages and $75 million in punitive damages.
The second-largest award was a $73 million verdict handed down by a jury in Texas last year, though it was later slashed to $34.6 million under state laws capping punitive damages. The plaintiff, Martha Salazar, was injured by Johnson & Johnson’s Obtryx sling and developed nerve damage, chronic pain, infections, and other complications.
The verdict might press Boston Scientific to approve more settlements before facing additional trials. Last month, the company offered $119 million to resolve 3,000 lawsuits for about $40,000 per case. U.S. District Judge Joseph Goodwin has urged the company to come to the table or face potentially billions of dollars in losses.
Approximately 16,500 federal lawsuits are pending against Boston Scientific in federal court, with many more still pending in state courts around the nation.
