Victims of Indiana MegaBus Accident File Lawsuit

October 24, 2014 — Several students from Indiana have filed a lawsuit against MegaBus, seeking more than $100,000 in damages for injuries they suffered after the bus clipped a crashed car on the highway and rolled over into a ditch.

Before the accident, passengers reported hearing the bus driver complain that the windshield wipers were not working, making it difficult to see in the rain. According to attorneys:

“We suspect a malfunction in the windshield wipers prevented the bus driver from adequately seeing the road and contributed to the crash.”

IndyStar reports that one of the victims is a 25 year-old student from Saudi Arabia who was thrown from the bus when it rolled and suffered injuries to his head, brain, collarbone, ribs, and lungs.

According to the Chicago Tribune the accident occurred at about 4:35 a.m. on I-65 in near Greenwood, Indiana.

The MegaBus was driven by a 37 year-old man from Illinois who hit the back of a 2003 Saturn. The Saturn was driven by a 22 year-old who crashed “due to driver inattention” while checking his cell phone. The Saturn hit the cable barriers came to a stop with the end of the vehicle in the right lane. When the MegaBus hit the Saturn, it crashed into the cable barriers and rolled onto its side.

Out of 48 passengers, 18 were taken to hospitals for treatment. Members of the lawsuit are seeking compensation for injuries including a separated shoulder, broken arm, knocked-out teeth, contusions, facial cuts that needed stitches, hospitalization, and more.
