January 23, 2013 — USPLabs has offered to settle a DMAA class action lawsuit for $2 million. Customers who purchased the workout supplements OxyElite Pro or Jack3D may qualify for compensation if they submit a valid claim.
By settling the class action, USPLabs does not admit any wrongdoing. The company has faced criticism for selling their popular workout supplements with the ingredient DMAA (1,3-dimethylamylamine or “geranium extract”), which has been linked to serious, life-threatening side effects.
The plaintiffs in the class action represent other customers who purchased the supplements between January 1, 2008 and August 17, 2012. The terms of the settlement were approved by the Superior Court of California, Los Angeles County, in December 2012. USPLabs agreed to pay $2 million to settle a series of complaints alleging that the company made false and misleading statements about OxyElite Pro and Jack3D.
Last year, the U.S. Food and Drug Administration (FDA) sent USPLabs a warning letter for selling products containing DMAA, an unapproved ingredient in dietary supplements. USPLabs responded by re-formulating the ingredients in Jack3D to remove DMAA, creatine, and beta-alanine. It has been re-branded as Jack3D Micro.
According to an FDA Warning Letter from April 2012:
“Synthetically-produced DMAA is not a ‘dietary ingredient’ and, therefore, is not eligible to be used as an active ingredient in a dietary supplement.”
Furthermore, the FDA warns that DMAA is known to narrow the blood vessels and arteries, which can cause high blood pressure, shortness of breath, tightening in the chest, heart attack, and other cardiovascular events. The agency also warned that they had received 42 reports of injury related to DMAA products, including heart problems, nervous system disorders, psychiatric disorders, and death.
