Texas lawyer for IVC filter side effects.May 9, 2016 — Two federal lawsuits were filed in Kentucky against Cook Medical and Boston Scientific by women who were severely injured by IVC filters.

The companies are accused of selling defective and “unreasonably dangerous” medical devices that can migrate, damage internal organs, and require emergency surgery to remove.

The lawsuit (PDF) against Boston Scientific was filed by Katherine Milan, a woman who was implanted with the Greenfield IVC filter in June 2005. By 2010, the filter was clogged with blood clots (occluded). The diagnosis was confirmed in a CAT scan in August 2015. She claims the IVC filter caused extensive blood clots and excruciating pain in her thigh and lower abdomen.

The case is Katherine Milan v. Boston Scientific (Case No. 5:16-cv-65TBR).

The lawsuit (PDF) against Cook Medical was filed by Olenda Holmes, a woman who was implanted with the Celect IVC filter in February 2013. By July 2015, she experienced chronic pain in her lower back and legs. After a CT scan, doctors discovered that the filter had tilted and caused a severe blood clots in her left leg.

Holmes was implanted with a Cook Option IVC filter above the Celect. As a result, she will have to be on long-term blood-thinning medications to prevent blood clots. According to the complaint:

“Defendants knew or should have known that its Cook Filter when used as expected and intended, had the possibility of shifting, breaking free its implantation site, migrating, perforating the vena cava, and causing serious injury and/or death to patients.”

The case is Olenda Homes et al. v. Cook Medical Inc. et al. (Case No. 5:16-cv-00066) in the U.S. District Court for the Western District of Kentucky.

As of mid-April, Cook Medical was facing about 350 federal lawsuits involving IVC filters. The cases are centralized under U.S. District Judge Richard Young in MDL No. 2570. C.R. Bard is facing at least 380 federal lawsuits in MDL No. 2641 under U.S. District Judge David Campbell.
