Thousands of lawsuits have been filed by people who were injured by Zyprexa, but not as part of a class action. Instead, they are individual lawsuits filed by people who were injured by severe side effects.
Need a Texas Zyprexa Lawyer? Collen A. Clark is a true advocate for his clients and is passionate about helping Texans that have been injured or wronged. If you or a loved one was diagnosed with a severe side effect, you should contact our lawyers immediately. You may be entitled to compensation by filing a lawsuit.
Zyprexa lawsuits are nothing new — Eli Lilly & Co. settled over 18,000 lawsuits in 2007 for $500 million. Including settlements before 2007, the company paid $1.2 billion to resolve claims on behalf of nearly 30,000 people who were injured by Zyprexa side effects.
In 2009, the company paid another $1.42 billion settlement with the Justice Department over illegal “off-label” marketing of Zyprexa for unapproved uses — including dementia. Zyprexa is known to increase the risk of death for people with dementia.
FDA Safety Warnings
The problem is that people continue coming forward to report serious injuries, like skin reactions, heart attack, coma, and the death of loved ones.
The FDA has also continued to issue warnings about newly-discovered side effects. In May 2016, the agency issued a Safety Communication after receiving 23 reports of patients who developed a rare but severe skin reaction known as Drug Reaction with Eosinophilia and Systemic Symptoms (DRESS).
Zyprexa “Black Box” Warning
The label on Zyprexa has a “Black Box” warning that it increases the risk of death in patients with dementia-related psychosis. In clinical trials involving 5,106 elderly patients with dementia, Zyprexa was associated with a 60% increased risk of death.
About 4.5% of patients treated with Zyprexa died, compared to 2.6% in the placebo group. The most common causes were cardiovascular (e.g., heart failure, heart attack, sudden death) or infectious (e.g., pneumonia).
What is the problem?
The Clark Firm, LLP is nationally recognized as a class action law firm in Texas. However, at this time our lawyers are not filing a Zyprexa class action against Eli Lilly & Co. Instead, we are filing individual lawsuits on behalf of people who experienced severe side effects.
About Class Actions
Class actions are designed to maximize efficiency and help a lot of people seek justice all together. They are a good way for a lot of people to seek refunds after buying a defective product. However, they can have disadvantages for people with severe injuries.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action
When a lot of people are injured by a defective medication, lawyers typically file individual lawsuits rather than a class action. This has many advantages. For example, plaintiffs do not have to share the payout and each case can go to trial.
Our lawyers specialize in helping people who were injured by medications seek compensation for their medical bills, pain and suffering, lost income, permanent injuries, wrongful death of loved ones, and more.
