FDA Warning: “Stop Using THC Vaping Products”
The FDA is warning the public to stop using THC vape products or any vaping products bought off the street due to a risk of severe lung damage and death. A majority of vape products have tested positive for THC in this outbreak investigation.
Over 2,400+ Cases of Vape Lung Disease; 52nd Death Reported
As of December 10, 2019, the CDC has reported a total of 2,409 people were hospitalized with vape lung injuries in all 50 states, including 52 people who died.
No single product has been blamed on the outbreak, but many victims reported using THC (marijuana) vaping products. Investigators also believe an oily contaminant called Vitamin E may be triggering severe lung damage in some people.
Vitamin E acetate is used as an additive, most notably as a thickening agent in THC-containing e-cigarette, or vape products.
All of the victims suffered from cough, shortness of breath, fatigue and other symptoms that worsened until they had to be hospitalized.
Vape Explosion Lawsuits
Dozens of lawsuits have been filed by people who were injured or burned by exploding vape batteries and e-cigarettes. Hundreds of incidents have been reported, including people who were permanently blinded in the explosion.

Vape Liquids Contain Chemicals Linked to Lung Disease
Vaping liquids usually contain nicotine and a combination of other ingredients. They do not have to contain flavoring chemicals, but most do — over 7,000 flavored vaping liquids are on the market. Many of them are sold in sweet flavors like candy and fruit that might appeal to children.
The problem is that some of the most common flavoring chemicals — diacetyl, acetyl propionyl, acetoin, 2,3-pentanedione, and more — are also known to cause lung disease when they are routinely inhaled.
The risk was discovered after hundreds of workers at microwave popcorn factories were diagnosed with bronchiolitis obliterans (“Popcorn Lung”). This incurable lung disease causes coughing, shortness of breath, and fatigue. Severe cases can be fatal.
No one knows if vaping causes lung disease, but studies have found that many vaping liquids contain amounts of diacetyl that significantly exceed the daily occupational exposure limit for popcorn factory workers. For example, one study published in 2015 by researchers at Harvard found diacetyl in 76% of 51 flavored vaping liquids that were tested.
Vape Class Action Lawsuits
Five Pawns, Inc., a manufacturer of high-end vaping liquids, was hit with a class action (PDF) in November 2015. Lab tests on several flavors discovered exceptionally high amounts of diacetyl and acetyl propionyl.
The lawsuit also accuses Five Pawns of lying to customers by insisting the liquids did not contain diacetyl. Tests on one liquid, Absolute Pin, found 40 μg/ml of diacetyl and an astonishing 2,500 μg/ml of acetyl propionyl:
“This means, if a person inhales just 2ml of Absolute Pin e-liquid they will be over the recommended intake for DA and more than 36 times over the recommended daily limit for AP.”
Cuttwood Vape Class Action
On November 23, another class action (PDF) was filed against Cuttwood LLC. The company was accused of selling vaping liquids containing diacetyl and acetyl propionyl in “the highest concentration that has ever been seen in any e-liquid.” Click here to read more.
