Shoulder replacement lawsuits have already been filed against Zimmer Biomet, but not as part of a class action. Instead, they are individual lawsuits by people who were injured by the recalled Comprehensive Reverse Shoulder implant.

Comprehensive Reverse Shoulder Replacement Recall
In February 2017, Zimmer Biomet recalled Composite Reverse Shoulder Replacements that were manufactured before 2011 due to a high rate of fractures and revision surgeries.
Approximately 3,662 of the recalled shoulder replacements were distributed from October 2008 to September 2015. According to the FDA:
“Fractures may result in revision surgeries which could cause serious adverse health consequences such as permanent loss of shoulder function, infection, or rarely, death.”
Biomet also issued Class II recalls for the Comprehensive Reverse Shoulder in April 2011 and September 2010 due to manufacturing errors and complaints about fractures between the baseplate and trunnion.
$350,000 Shoulder Replacement Lawsuit Settlement
In February 2016, Zimmer Biomet paid $350,000 to settle a lawsuit involving a person who needed revision surgery when two Comprehensive Reverse Shoulder implants fractured. Both implants were recalled in 2010 — Case No. 14-02667.

About Class Actions
Class actions are a good way for a lot of people to seek compensation for some types of legal claims — bank overcharges or refunds for defective products, for example. However, class actions are not designed to maximize compensation for individuals with severe injuries.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action
The problem with class actions is that everyone who joins the lawsuit must share the payout. This is a problem for people with the most serious injuries who are facing massive medical expenses or disability.
This is why most people who are injured by defective medical devices file individual lawsuits. Our lawyers specialize in holding manufacturers accountable for selling defective shoulder replacements. If you were injured, we may be able to help you file a lawsuit.
