UPDATE: Fisher-Price Rock ‘n Play Linked to 100 Deaths
In January 2023, Fisher-Price re-announced a recall for 4.7 million Rock ‘n Play Sleepers after 8 more deaths were reported, bringing the total number to approximately 100 babies who suffocated to death in the product.
In a statement from CPSC Chairman Alexander Hoehn-Saric:
“We are issuing this announcement because, despite their removal from the marketplace and a prohibition on their sale, babies continue to die in these products. … Unfortunately, today’s announcement highlights the fact that these products are still in too many homes, and babies continue to be put at risk.”
Congress Bans Deadly Inclined Sleepers & Crib Bumpers
In May 2022, the U.S. Senate and House of Representatives passed the Safe Sleep for Babies Act of 2021, a bill that will ban deadly inclined sleepers and crib bumpers. The ban will include products like the Fisher-Price Rock ‘n Play and similar products with an inclined sleep surface greater than 10º.
Fisher-Price Admits 97 Babies Died in Rock ‘n Play Sleepers
In shocking testimony to Congress in June 2021, executives at Fisher-Price admitted that they were aware of 97 infant deaths in the Rock ‘n Play Sleeper. Fisher-Price also said they made around $200 million in sales of the Rock ‘n Play, and they fought against a recall as babies continued to die.
Texas Mom Files Rock-n-Play Class Action Lawsuit
Linda Black, a mother from Palestine, Texas, filed a Rock ‘n Play Class Action Lawsuit (PDF) on April 23, 2019. She claims she never would have bought the Rock ‘n Play Sleeper from a Walmart if she had known that it was dangerous and unfit for a sleeping baby.
The lawsuit was filed int he U.S. District Court for the Central District of California — In RE: Linda Black v. Mattel Inc. and Fisher-Price Inc. — Case No. 2:19-cv-03209.
What is the Problem?
At least 3 class action lawsuits have been filed against Fisher-Price, but NOT for the babies who were injured or died in a Rock-n-Play.
Instead, these class actions are trying to force Fisher-Price to pay refunds or other compensation to everyone who bought a Rock-n-Play Sleeper, even if their baby was not injured.
Rock-n-Play Lawsuits in Texas
