Rideshare Car Accident Lawsuits
The rideshare apps Uber and Lyft offer a $1,000,000 insurance policy for passengers and drivers who are in car accidents. Coverage for injuries and medical expenses applies in the following examples:
- Rideshare passengers who were injured on a trip
- Rideshare drivers who were injured in car accidents that were not their fault (payouts depend on whether the driver had a passenger at the time or not)
- Motorists injured in car accidents caused by a rideshare driver
What is the Problem?
Lawyers blame many of these incidents on ride-sharing companies failing to screen their drivers. Uber and Lyft do not use fingerprints or law enforcement to background-check their drivers. Uber does not meet their drivers in person before allowing them to drive passengers.
The website www.WhosDrivingYou.com identified hundreds of reports of ride-sharing incidents, including:
- Car accidents
- Physical assault and battery
- Sexual assaults and rape
- Felon drivers
- And more
Hundreds of Rideshare Sexual Assaults Reported
There are over 200 reports of women who were sexually assaulted, raped, stalked, kidnapped, or harassed by their rideshare driver. In May 2017, a UC Riverside college student was raped by her Uber driver. Just days earlier, a Lyft driver raped a 14 year-old girl in Florida.
Uber Sexual Assault Lawsuit Settlements
In November 2016, Uber paid a settlement to resolve two unnamed women who were sexually assaulted by their drivers. One woman said a driver in South Carolina drove her the wrong way home, asked her to perform oral sex as “payment,” and then “viciously raped” her in August 2015. The other woman said a 38 year-old Uber driver forcibly kissed and groped her in February 2015.
Criminal Rideshare Driver Lawsuit
In January 2017, Uber was hit with another sexual assault lawsuit from a woman who was raped. Lawyers say her driver never should have been hired because he had a criminal history.
In August 2015, California’s district attorney said flaws in rideshare driver background checks allowed 25 men with criminal records — including murder, child abuse, and assault — to work in Los Angeles and San Francisco, California.
One of the drivers was a convicted murderer who spent 26 years in prison before he was paroled in 2008. In another case, a man who sexually abused a child under 14 years old was allowed to give “5,697 rides to Uber passengers, including unaccompanied children.”
$32 Million “Safe Rides” Class Action Settlement
In June 2017, Uber agreed to pay a $32.5 million class action lawsuit settlement for charging passengers a “Safe Rides” fee and advertising an industry-leading driver background-check. In reality, Uber used a private 3rd-party company to do the checks, which lawyers called “woefully inadequate.” Under terms of the settlement, Uber will be allowed to change the “Safe Rides” fee to “Booking Fee” in the app.
