In August 2021, an investigation by KATV.com, an ABC News affiliate in Los Angeles, found more than 3,290 reports of Paragard IUDs breaking during the removal procedure because they were embedded in a woman’s body. At least 2,000 reports were classified as “serious.” The manufacturer is currently facing over 200 lawsuits from women who say they were never warned about the risk, despite the company quietly updating the label on Paragard in 2009 to include breakage during the removal procedure.

What is Paragard?

Paragard® (Copper IUD) is a non-hormonal birth control device that is implanted in the uterus, where it uses copper to prevent pregnancy.

Paragard looks like a plastic, T-shaped device with a copper wire coiled around it. The copper causes inflammation that is toxic to sperm and eggs. It reduces the risk of pregnancy for up to 10 years.

Since 2010, the FDA has received more than 1,600 reports of Paragard IUDs breaking during removal, with more than 700 of those incidents resulting in “serious health problems,” according to lawsuits.

What is the Risk?

Doctors may be unable to find the broken pieces of a Paragard IUD. This is because the pieces can travel or become completely embedded in the uterine wall. This could lead to complications like:

  • Severe menstrual pain
  • Heavy bleeding
  • Irregular spotting
  • Inflammation (Pelvic Inflammatory Disease)
  • Infections
  • Organ perforation / organ damage
  • Infertility

Paragard Lawsuits

Lawsuits claim that Teva Pharmaceuticals did not supply doctors with adequate instructions on how to safely remove Paragard IUDs. For example, doctors can avoid breaking the IUD’s T-shaped arms off by gripping both of the arms of the IUD during the explant procedure.

Lawsuits also accuse Teva Pharmaceuticals and CooperSurgical Ind. of failing to adequately warn women — especially young women who wanted to get pregnant — that they may need a hysterectomy surgery to remove the broken parts of an IUD that got stuck in their uterus.

Can I Join a Class Action?

Dozens of Paragard lawsuits have been filed nationwide, but not as part of a class action. Instead, these lawsuits could potentially join a Multi-District Litigation (MDL).

MDLs are not a class action because each lawsuit remains independent. Class actions combine all of the cases into one lawsuit.

Like a class action, MDLs help the courts speed up proceedings by having one judge make all the pretrial decisions. This is much faster than having thousands of individual lawsuits work through the court system, or risk wildly inconsistent rulings in cases in different courts.
