Lawsuits Filed After Deadly Acid Leak at LyondellBasell Chemical Plant

In July 2021, the first lawsuits were filed within days of a deadly acid leak at the LyondellBasell chemical plant near La Porte, Texas.

The lawsuits were filed by Bryant H. and Mike L., two workers who were in the chemical facility during a massive leak of acetic acid. One man suffered lung injuries from breathing chemical fumes, as well as back and knee injuries when he was forced to “flee for his life.”

LyondellBasell is accused of “gross negligence” for failing to immediately fix the leak when it was discovered earlier in the day. Both men are seeking at least $1 million in financial compensation.

“Plant explosions cause some of the most horrific industrial injuries we encounter, and they are often exacerbated by injuries workers sustain while trying to flee to safety,” his lawyers said.

What Happened?

LyondellBasell discovered a leak of acetic acid early in the day on July 27, 2021. Rather than fix it immediately, as recommended by experts who initially evaluated the leak, the company decided to reach out to contractors for a temporary repair.

Later that day, at around 7:35 p.m., roughly 100,000 pounds of acetic acid burst out of a broken cap on a pressurized line.

Workers in the facility were exposed to a vapor cloud of acid. Two men who were working as contractors in the facility died at the scene of the accident. Another 30 workers were hospitalized with respiratory issues, chemical burns, and other injuries related to escaping.

What is Acetic Acid?

Acetic acid is a chemical that is used in food-grade vinegar. In this accident, the leak involved an acetic acid reactor solution, meaning that the acetic acid was mixed with other hazardous chemicals, including solvents and methyl iodide.

These toxic chemicals are extremely dangerous to eat or breathe. Exposure can result in burn injuries to the skin, shortness of breath, fluid build-up in the lungs, nausea, and headaches. Acetic acid is also flammable and corrosive.
