$100 Million Legionnaires’ Disease Class Action Lawsuit

At least 61 people were infected with Legionnaires’ disease in Flint, Michigan after city officials switched to using water from the Flint River in June 2014. Lawyers recently filed a $100 million class action lawsuit on behalf of victims, including one who died.

Legionnaires’ Outbreak Class Action in Canada

A class action lawsuit was filed in Canada after a deadly outbreak of Legionnaires’ disease in Quebec City in 2012. The outbreak killed 14 people and infected at least 181 others. It was eventually traced to a cooling tower of a downtown office building.

What Causes Legionnaires’ Disease?

Legionnaires’ disease (also known as “legionellosis“) is a lung infection (pneumonia) with a water-borne bacteria called Legionella. Outbreaks typically occur when Legionella grows in a building’s water system and people breathe it in the air.

How Do Infections Occur?

Legionnaires’ disease is caused by breathing in tiny droplets of water containing Legionella bacteria. Exposure can occur from a building’s water (hot tubs, pools, fountains, showers, etc.), cooling tower, or air conditioning. Outbreaks are often traced to hotels, hospitals, casinos, cruise ships, and older apartment buildings.

Symptoms of Legionnaires’ Disease

The symptoms develop within 10 days of exposure, and may include:

  • Cough (may be bloody)
  • Fever
  • Shortness of breath
  • Chest pain
  • Nausea, vomiting
  • Diarrhea
  • Headache
  • Confusion

What is the problem?

The Clark Firm, LLP is nationally recognized as a class action law firm, but we are not filing a class action lawsuit for victims of Legionnaires’ disease outbreaks. Instead, we are filing individual lawsuits for people who were diagnosed with this severe disease.

About Class Actions

Class actions are sometimes filed on behalf of everyone who was exposed to Legionella after outbreaks of Legionnaires’ disease. These lawsuits are not designed to maximize compensation for people who were actually infected with Legionella.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

The problem with class actions is that people with severe injuries must share the payout with everyone who joins the lawsuit. They may also have to accept a “low-ball” settlement or higher attorneys’ fees.

Instead of a class action, our lawyers are filing individual lawsuits for people who were diagnosed with Legionnaires’ disease. We help victims of these outbreaks recover compensation for pain and suffering, medical bills, lost income, disability, or wrongful death.
