Hotel Sex Trafficking Lawsuits
A growing number of lawsuits have been filed nationwide against major hotel chains. Lawyers have asked federal judges to centralize these lawsuits into a single court in Ohio, in a Multi-District Litigation (MDL). Texas: 1st State to Make Buying Sex a Felony
In August 2021, Texas becoming the first state in the U.S. to make buying sex a felony, punishable by at least 6 months in jail. The state unanimously passed HB1540 to crack down on the so-called “johns” who pay for sex, rather than the people who engage in prostitution.
Texas Hotels Must Look For & Report Sex Trafficking
Lawmakers recognize that hotels are frequently used for sex trafficking activities. In 2021, the Texas Legislature passed House Bill 390, which requires hotel employees to receive annual human trafficking awareness training. The law also requires hotels to put up signs telling employees how to report human trafficking.
Signs of Sex Trafficking at Hotels & Motels
Hotel staff may see signs of sex trafficking, such as:
- Large amount of foot traffic in and out of the room
- Individual stays at the hotel without luggage
- Individual who is dressed highly inappropriately, especially a child
- Individual looks malnourished, poor hygiene, tired, drugged, bruises or untreated illness or injuries, submissive or abnormal behaviors
- Individual has no money or ID
- Excessive amount of sex paraphernalia in the room
- Repeated requests for sheets, towels, etc.
Texas Girl Sex Trafficked From Dallas Mavericks Game
In February 2024, a hotel sex trafficking lawsuit was filed by the family of a 15-year-old girl who was kidnapped from a Dallas Mavericks game and sexually trafficked at a hotel in Oklahoma.
The girl was reported missing by her father, who said she went to the bathroom at the Dallas Mavericks game and never came back.
Oklahoma City Police found her about 10 days later at an Extended Stay America hotel, where she had been drugged and forced into prostitution.
The lawsuit claims that hotel employees “either failed to recognize the signs … or chose to turn a blind eye and ignore what was happening.” The lawsuit claims that men armed with assault rifles patrolled the hallways and paid for multiple rooms in cash, which should have been red flags to alert hotel staff of criminal activity.
Sex Trafficking Lawsuit Filed Against Radisson Hotel in Texas
In December 2023, a woman identified as “Jane Doe” filed a sex trafficking lawsuit alleging that she was sexually exploited at hotels in Texas.
The woman claims that she was forced to perform commercial sex acts between 2012 and 2014 at hotels located in Austin, Texas, such as Country Inn & Suites, Americas Best Value Inn, Baymont Inn & Suites, Days Inn, Orangewood Inn & Suites and Super 8.
Her lawsuit was filed on November 30, 2023 in the U.S. District Court for the Western District of Texas (Austin Division) — Case Number 1:23-cv-01456.
