Class Action Lawsuit Filed Against Genki Sushi
Layers in Honolulu have filed a class action against Genki Sushi. They are seeking anyone who ate or drank at Genki Sushi since April and required a Hepatitis A vaccine or immune globulin (IG) shot. There is also a separate class action involving around 80 people who were actually diagnosed with hepatitis A. Click here to read more.
1st Lawsuit Filed in Hepatitis A Outbreak
The first lawsuit (PDF) has been filed against Genki Sushi by a man from Oahu who tested positive for hepatitis A. He was hospitalized for 7 days and diagnosed with liver inflammation. Click here to read more.
Genki Sushi “Likely Source” of Outbreak
The Hawaii Department of Health said the “likely source” of the outbreak is raw scallops served at Genki Sushi restaurants. The tainted product is called “Sea Port Bay Scallops” and it was distributed by Koha Oriental Foods on Honolulu. The product was shipped frozen from the Philippines and served raw at Genki Sushi.
Hepatitis A Outbreak Sickens 292 People
As of January 11, 2017, there were 292 confirmed cases of hepatitis A since June 12, 2016. All of the victims were adults and 74 had to be hospitalized. Only 18 of the victims were not from Oahu. Genki Sushi shut down 11 restaurants in Hawaii for cleaning.
Warning Signs & Symptoms of Hepatitis A
Hepatitis A is a virus that causes liver inflammation. The symptoms can take 2-6 weeks to appear. When they do, victims often feel very sick for several months. Severe infections can cause permanent liver damage or even death. Symptoms may include:
- Low-grade fever
- Fatigue
- Loss of appetite
- Nausea and vomiting
- Abdominal pain
- Joint and muscle aches
- Jaundice (yellowing of skin and eyes)
What is the problem?
The Clark Firm, LLP is nationally recognized as a class action law firm, but we are not filing a class action lawsuit against Genki Sushi. Instead, we are filing individual lawsuits for people who were diagnosed with hepatitis A.
About Class Actions
In massive food poisoning outbreaks, a class action lawsuit does not work well — some victims are sick for a week, while others are hospitalized and face months of debilitating symptoms. With such wide variety of injuries, each case needs to be handled individually.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action
Class action lawsuits are very efficient when a lot of people have similar legal claims, but they are not designed to maximize compensation for individual plaintiffs with the most serious injuries. Instead of a class action, our lawyers are filing individual lawsuits.
We believe there is no excuse for serving food tainted with hepatitis A, a virus found in human feces. If you were sickened, you could be eligible for compensation for your pain and suffering, medical expenses, permanent injuries, and more.
