Texas Family Awarded $3 Million in Fracking Lawsuit
In April 2014, a jury in Texas awarded $3 million to a family who lost property value and experienced severe health problems after more than 50 natural gas wells opened within a 2-mile radius of their ranch.
Overview
Hydraulic fracturing, or “fracking,” is a technique for extracting oil and natural gas. It involves injecting fluids deep underground to break up shale deposits, and then sucking the mixture out of the ground.
Fracking and Earthquakes
Fracking causes very small earthquakes. Strong earthquakes are primarily associated with wastewater injection wells. These wells are used to dispose of millions of gallons of water, radioactive materials, and toxic chemicals produced by fracking operations.
Large wells — especially those located along unstable faults — are known to cause earthquakes. The number of earthquakes has increased dramatically in the last few years. From 1973-2008, there were an average of 21 earthquakes 3.0-magnitude or greater in the United States. This rate jumped to 99 quakes from 2009-2013, and 659 in 2014.
Water Contamination Class Action Filed in Arkansas
In the Fayetteville Shale deposits in Arkansas, two couples filed a class action lawsuit after toxic chemicals from fracking contaminated their drinking water. The lawsuit represents all Arkansas residents who live on or own property within 3 miles of any gas-extraction activities.
Oklahoma Earthquake Class Action
Several class action lawsuit have claimed that fracking wells caused earthquakes in Arkansas and other states. After two earthquakes over 4.0-magnitude hit Oklahoma, a group of homeowners filed a class action lawsuit against 12 energy companies for property damage.
What is the problem?
The Clark Firm, LLP is nationally recognized as a class action law firm in Texas, but we are not filing a fracking class action. Instead, we are filing individual lawsuits for people who had property damage or water contamination from earthquakes associated with fracking.
About Class Actions
Class actions are very efficient when a lot of people have similar legal claims. However, they are not designed to maximize compensation for people with the most serious injuries or financial losses.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action
The problem with a class action for fracking is that each lawsuit is so different. Some victims have only minor injuries, while others have severe health problems, property damage, or contaminated wells.
Instead of a class action, we are filing individual lawsuits against oil and gas companies who contaminate drinking water or damage property. If you decide to file a lawsuit, you could receive compensation for your injuries, financial losses, and more.
