Fertility centers cost upwards of $8,000 to collect and freeze human eggs and embryos, plus yearly costs of around $600 to store the tissues until the parents choose to fertilize the eggs at a later date. San Francisco Fertility Clinic Lawsuit
Pacific Fertility Center in San Francisco, California was hit with a $5 million class action lawsuit on behalf of over 100 parents whose frozen eggs and embryos were destroyed by a malfunctioning freezer.
Pacific Fertility Center blamed the loss on a cryogenic tank that “lost liquid nitrogen for a brief period of time” on March 4.
What is the Problem?
Now, many parents and their lawyers are demanding to know why this disaster occurred. The eggs and embryos require a steady supply of liquid nitrogen to stay frozen in their cryogenic tanks. If the liquid nitrogen evaporates or the lid of the tank is open, the eggs will thaw.
The class action was filed by Megan and Jonathan Bauer, a couple from California who were paying $600 per year to Pacific Fertility Center. They lost 8 embryos when the freezer malfunctioned.
The Bauers now say they “feel like their dreams of having children together in the near future have been stolen.”
Legal Claims in Class Action Lawsuit
The class action is seeking compensation from Pacific Fertility Center for breach of contract, negligence, financial and emotional damages.
They accuse Pacific Fertility Center of failing to adequately monitor the tanks, permitting a leakage to occur from one of the tanks, and failing to properly safeguard the frozen eggs and embryos.
Ohio Fertility Center Class Action Lawsuit
In March 2018, a Class Action Lawsuit (PDF) was filed against University Hospitals Fertility Center in Ohio on behalf of 700 parents who lost about 2,000 frozen eggs and embryos when a freezer malfunctioned.
Lawyers expect dozens of lawsuits to be filed, but the first class action was filed by Amber and Elliot Ash, a couple who had 2 embryos stored at the fertility center.
The couple were notified on March 10 that their embryos were no longer viable. After filing the lawsuit, they said:
“It’s heartbreaking. Just heartbreaking. The medical community calls it tissue, I like to think of it as my children. My frozen children.”
