October 11, 2013 — OxyElite Pro, a weight-loss supplement manufactured in North Texas, has been linked to 24 cases of liver damage. One woman died after taking OxyElite Pro for several weeks.
USPLabs, the manufacturer of OxyElite Pro, is headquartered in Dallas, Texas. Earlier this year, they paid over $2 million to settle a class action lawsuit involving violations of false-advertising laws in California.
As part of the agreement, USPLabs did not admit wrongdoing, but they agreed to change the label and make warning statements clearer. Even so, many experts are concerned that many consumers who use OxyElite Pro are putting their health at risk.
Dr. Ross Tobleman, director of emergency medicine at Scott & White Hospital in Round Rock, warned:
“It is certainly ‘buyer beware’… When that medication or that herbal supplement can be potentially dangerous, especially in higher amounts, that’s when people start getting into trouble. … They’re using terms like ‘natural’ and ‘pro,’ and it’s marketing. It’s out there for everybody instead of saying, ‘This is a serious substance.’”
Although USPLabs has not issued an official OxyElite Pro recall, they have agreed to stop distributing the product. Health officials in Hawaii ordered GNC to remove the product from store shelves; after initially refusing, the company agreed to stop selling it until the investigation is complete. In the meantime, OxyElite Pro has been embargoed and is illegal to sell in Hawaii.
