Flavored e-cigarettes and vaping liquids usually contain chemicals like diacetyl that have been linked to lung disease. Now, several manufacturers are facing class action lawsuits for failing to warn about the risk.

What is Diacetyl?

Diacetyl is a chemical that is used to create a buttery or creamy flavor. It is safe to eat and drink in food, but breathing diacetyl is associated with lung disease. Diacetyl is also substituted with acetyl propionyl or 2,3-pentanedione.

Diacetyl and “Popcorn Lung”

The link between diacetyl and lung disease was established in the 1990s and early 2000s, after hundreds of workers at microwave-popcorn or flavoring factories were diagnosed with bronchiolitis obliterans.

The disease, also known as “Popcorn Lung,” causes inflammation and scarring in the smallest airways of the lungs. The damage is irreversible, progressive, and can cause disability or death. Symptoms may include:

  • Cough (usually without phlegm)
  • Wheezing
  • Shortness of breath that worsens on exertion
  • Fever
  • Night sweats
  • Weight loss

Diacetyl and E-Cigarettes

Most flavored e-cigarettes and vaping liquids contain diacetyl, according to several recent studies. Researchers at Harvard analyzed 51 vaping liquids and found diacetyl in 76% of products. The amount of diacetyl ranged up to 239 μg/e-cigarette — nearly 4X the recommended daily exposure limit set by the government.

Diacetyl Class Action Lawsuits

In November 2015, class action lawsuits were filed against Cuttwood, LLC, Five Pawns Inc., and other vaping liquid manufacturers for selling products containing diacetyl. One of those manufacturers, Five Pawns Inc., was accused of selling products with massive amounts of flavoring chemicals. According to the lawsuit (PDF):

“If a person inhales just 2ml of Absolute Pin e-liquid they will be over the recommended intake for [diacetyl] and more than 36 times over the recommended daily limit for [2,3-Pentanedione].”

What is the problem?

The Clark Firm, LLP is nationally recognized as a class action law firm in Texas. However, we are not filing a class action lawsuit against the manufacturers of vaping liquids containing diacetyl. Instead, we are filing individual lawsuits on behalf of people who were diagnosed with lung diseases after vaping, such as:

About Class Actions

Class action lawsuits against the makers of vaping liquids are not seeking compensation for lung damage. Instead, they are seeking reimbursement and additional compensation on behalf of everyone who purchased vaping liquids without proper warning about diacetyl or its side effects.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

For people with severe diseases like bronchiolitis obliterans, a class action lawsuit could have disadvantages. Members might have to accept a “low-ball” settlement or higher attorneys’ fees. Instead of a class action, our attorneys file individual lawsuits. We focus our efforts on seeking justice and maximizing compensation for people with the most serious injuries. If you were harmed by diacetyl in vaping liquid, you may be eligible to join this litigation.
