$18 Million Awarded in Clubman Talc Lawsuit
In October 2016, a jury in Los Angeles awarded $18 million to a man who was diagnosed with mesothelioma from exposure to asbestos in talcum powder products at the barbershops where his father worked.
The lawsuit was filed by Philip Depoian, a man who was blames his cancer on exposure to Clubman, Old Spice, Kings Men, and Mennen Shave Talc.
The talc company Whittaker, Clark and Daniels paid Mr. Depoian a confidential settlement before the jury could award punitive damages. Lawyers accused the company of marketing its talc as asbestos-free but failed to conduct any tests on the talc to prove it was actually safe.
The lawsuit was filed in Los Angeles Superior Court — In Re: Philip Depoian et. al., vs. American International Industries, et al. — Case No. No. BC607192.
Is Talc Harmful to Health?
Talc is an extremely soft silicate mineral like asbestos and they are often found together in the same mines underground. Before 1976, talcum powder was often contaminated with asbestos. Some products had up to 20% asbestos fibers instead of talcum powder.
What is the problem?
The problem is that asbestos is a known carcinogen. Under a microscope, asbestos looks like a bundle of tiny needles. Breathing it is extremely irritating to the lungs. Exposure is associated with mesothelioma, a rare but often deadly type of lung cancer.
Does Clubman Talc Have Asbestos?
The FDA banned asbestos in cosmetics in 1976. Talcum powder is now supposed to be asbestos-free, but the vast majority of talc is never tested for contamination. There is no guarantee it is actually safe because studies continue to associate talcum powder and cancer.
Clubman Talc and Ovarian Cancer
Clubman Talc has a distinctive cologne scent for men and it is advertised as a finishing aftershave powder. It is not likely that many women used Clubman regularly on their genital area. However, studies show that women who use talcum powder genitally are 20-30% more likely to be diagnosed with ovarian cancer. Both mesothelioma and ovarian cancer start in epithelial cells on the outer surface of the lungs or ovaries.
What is Mesothelioma?
Early symptoms of mesothelioma are easily mistaken for other illnesses. The symptoms may not appear for decades after the person was exposed to asbestos or contaminated talcum powder. When symptoms do appear, they may include:
- Chest pain
- Shortness of breath
- Fever
- Abdominal pain
- Fluid buildup
- Loss of appetite
- Nausea
- Weight loss
