Blue Bell Recalls All Ice Cream Due to Listeria
On April 20, 2016, Blue Bell recalled all ice cream products from all production facilities due to possible contamination with Listeria. Listeria Food Poisoning
The bacteria Listeria monocytogenes can cause an infection known as listeriosis. While most healthy adults recover without needing treatment, the illness can be life-threatening for people with vulnerable immune systems. Pregnant women can also suffer a miscarriage.
Sympotoms of Listeriosis
Symptoms typically appear 3-70 days after eating contaminated food, and last for a few days or weeks. These symptoms may include:
- Fever
- Stiff neck
- Confusion
- Weakness
- Vomiting
- Diarrhea
What is the problem?
The Clark Firm, LLP is nationally recognized as a class action law firm in Texas, but our attorneys are not filing a class action lawsuit against Blue Bell Creameries. Instead, our attorneys are filing individual lawsuits on behalf of people who were infected with Listeria after eating contaminated ice cream.
About Class Actions
Class actions are ideal when a large number of people are seeking the same legal remedy, such as reimbursement for a recalled product. It is possible that Blue Bell will face demands from consumers, retailers, and food service customers for damages related to the recall, according to Law360.
Why Our Lawyers Are Filing Individual Lawsuits as Opposed to a Blue Bell Class Action
Listeria infections are often life-threatening and require extensive medical treatment. For people with very serious injuries, class actions can have disadvantages. Members may have to accept a “low-ball” settlement, watch attorneys take a huge cut of the payout, and never get to see their case taken to trial.
Instead of a class action, our lawyers are filing individual lawsuits. We believe victims of deadly food poisoning outbreaks deserve an attorney who is committed to their case, seeking justice, and maximizing compensation for medical expenses, pain and suffering, wrongful death, and more.
