Volkswagen (VW) has admitted using illegal software called a “defeat device” to sense when the car is being tested for emissions and temporarily reduce emissions to meet legal standards.

But on the road, the cars emit 10-40X the legal limit of nitrogen oxide, a toxic gas that can cause respiratory problems. Even more troubling, the diesel vehicles were marketed as environmentally-friendly “Clean Diesel.”

About 11 million vehicles worldwide are affected, including about 13,000 Audi TDIs that were sold in the U.S. since 2009.

VW is now facing dozens of class action lawsuits from owners all over the U.S., including many Audi owners. According to one plaintiff, “Every reason that I bought the car was based on a lie.”

Performance vs. Emissions Trade-Off

The “defeat device” can be removed from the car by updating the software. However, because there is a trade-off between emissions and performance, fixing the car could noticeably decrease fuel-efficiency and performance. Retrofitting the exhaust system is another option, but it would cost thousands of dollars per vehicle and might affect resale value.
