A growing number of lawsuits have been filed by people who took HIV medications such as Atripla because they contain TDF, an ingredient that is linked to a higher risk of side effects in the bones, teeth, and kidneys.

HIV Drug Injury Lawsuits

In May 2018, a class action lawsuit was filed in California against Gilead Sciences for people who took Atripla and other anti-HIV medications that contain Tenofovir Disoproxil Fumarate (TDF).

What is TDF?

TDF is an older version of tenofovir — an antiviral medication that fights HIV. Unfortunately, TDF must be taken at high doses to be effective, which causes it to accumulate in the bones and kidneys. This increases the risk of bone loss, kidney damage, and tooth decay. This is why Gilead developed a safer version of tenofovir called TAF (Tenofovir Alafenamide), and now recommends that patients switch.

Did Gilead Delay Selling Safer HIV Drugs?

Gilead Sciences has been hit with individual lawsuits and class actions that accuse the company of maximizing profits by intentionally delaying the release of TAF until the patent expired on TDF drugs. As a result, many patients on Atripla developed severe side effects.

What is the problem?

The Clark Firm, LLP is nationally recognized as a class action law firm in Texas, but we are not filing an Atripla class action. Instead, we are filing individual lawsuits for people who developed severe side effects in their bones, kidneys, or teeth after taking Atripla for HIV or PrEP.

About Class Actions

Class actions are useful when a large group (or “class”) of people have nearly identical legal claims. However, class actions can be problematic for people with severe injuries. One problem is that any payout must be shared with everyone who joins the class action.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Our law firm is filing individual lawsuits for people who were injured by Atripla. We specialize in helping people who were injured by medications seek financial compensation for their pain and suffering, medical bills, lost income, disability, and other damages.
