In August 2026, two women in Michigan filed a lawsuit against Apple after they were stalked by ex-romantic partners using hidden AirTags. The case is part of a litigation that is moving through the federal court system.

Is This a Class Action?

No. On August 4, 2026, attorneys for the plaintiffs filed a motion asking the U.S. Judicial Panel on Multidistrict Litigation to consolidate the federal cases into a single federal court in Arizona under Judge Diane Humetewa.

What Makes a Hidden AirTag Dangerous?

AirTags are small, roughly the size of a quarter. The device works on Apple’s Find My network, where it borrows the Bluetooth connection of any nearby iPhone to report its location.

This is useful for finding lost keys or luggage on a cross-country flight, but there is also a risk of abuse. Stalking victims have reported being followed, located at parks, work and at home by their former romantic partners.

Lawyers claim that Apple knew about the risk before launching AirTags in 2021, and yet failed to launch the product with adequate safeguards in place.

How Did Two Women Find AirTags Hidden in Their Cars?

The lawsuit was filed by two women from Michigan who were secretly stalked. One woman had an iPhone but never received an alert about the unknown AirTag in her vehicle.

The other woman used an Android phone, but only realized that an AirTag was hidden in her car when her visiting niece, who had an iPhone, received an alert about the AirTag.

Why Didn’t the Anti-Stalking Alerts Warn Them?

The lawsuits describe an alert system that lagged for hours or days behind the tracking of the AirTag itself. The lawssuit claims this “failed to protect each Plaintiff from being tracked without her knowledge or consent.”

For example, specific issues named in the lawsuit include:

• At launch, a separated AirTag could take 3 days to sound an alert
• Alerts might not arrive for 4 to 8 hours after the tracking began
• When AirTags launched, there was no automatic alert for Android users who were being tracked
• Apple released a Tracker Detect app for Android in December 2021, but users had to know about the app, download it, and manually run the scan.
• Google and Apple implemented a cross-platform standard in May 2023
• Another problem is that the AirTag speaker can be removed by third-party sellers

Is It a Crime in Texas to Put a Tracker on Someone’s Car?

Yes. Under Texas Penal Code Section 16.06, a person commits an offense by knowingly installing an electronic or mechanical tracking device on a motor vehicle owned or leased by another person.

This law addresses the person who hid the device, but not the company that sold the device. The current AirTag litigation involves Apple, rather than people who were using AirTags to stalk their victims.

The criminal case against a stalker and a product liability claim against a manufacturer are separate types of claims, which means victims may be able to file a civil lawsuit even if the abuser was never charged for criminal conduct.
