What Should Texas Homeowners Know?

  • Companies: Microsoft, xAI, SpaceX, MZX Tech, Alliance Cloud Services, and DataOne USA
  • Texas lawsuit for data center noise: In Texas, 9 residents of Granbury sued MARA Holdings in May 2026 over noise from its Hood County data center
  • Types of legal claims: Nuisance and negligence, lost property value, loss of use and enjoyment of the home or land
  • Home value research: A September 2026 UC Berkeley working paper estimated an average 7.2% price drop within 1 mile of a large data center
  • Texas noise rules: Only the state and cities can set noise limits, not counties.

How Did Neighbors Realize Data Centers Were Hurting Their Home Values?

In Dowagiac, Michigan, a former Bitcoin mining site began running as a data center in early 2025, and neighbors on the street beside it say the whine never stops. Residents said a company executive even offered to buy their homes at fair market value.

Just south of the Tennessee line from Memphis, homeowners in Southaven say their trouble started in August 2025, when xAI’s gas turbine power plant on Stanton Road came online. One of them filed a police complaint and emailed the mayor, and the lawsuit says xAI added more turbines that December instead of quieting the site.

In Wisconsin, neighbors of Microsoft’s $7.3 billion Fairwater campus say a low hum follows them into their bedrooms and backyards. Their complaint argues the sound is too low in frequency for standard decibel meters to register, ESG Dive reported.

Where Have Homeowners Sued Over Lost Property Value?

  • Western District of Michigan, May 2026: Dowagiac homeowners sued Alliance Cloud Services, a Hyperscale Data subsidiary
  • Federal court in New Jersey, May 2026: Vineland neighbors sued DataOne USA (a procedural dismissal later ended this first complaint, per news reports)
  • Northern District of Mississippi, June 2026: Southaven residents sued xAI, SpaceX, and MZX Tech on behalf of more than 10,000 people
  • Eastern District of Wisconsin, July 2026: Mount Pleasant-area homeowners sued Microsoft

Each case asks a judge to let a few homeowners stand in for hundreds or thousands of neighbors. So far, no data center noise case has gone to trial or been decided on summary judgment, based on reporting through September 2026.

What Does the Research Say?

Economists with UC Berkeley and Harvard compared home sales near 346 large data centers against sales near sites that had not yet been announced. Their September 2026 working paper found that prices within 1 mile of a data center dropped 7.2% on average, with smaller declines out to 3 miles.

How Does Texas Law Handle Industrial Noise?

In 2016, the Texas Supreme Court clarified Texas nuisance law by using a lawsuit that was filed by ranch owners, who claimed noise from a natural gas compressor station across the road hurt their property value.

In that decision, Crosstex North Texas Pipeline, L.P. v. Gardiner, the court described a nuisance as a “substantial interference with the use and enjoyment of land that creates unreasonable discomfort or annoyance for people of ordinary sensibilities.” The decision confirmed that remedies can include money damages and an injunction.

Why Do Rural Texans Have So Few Options?

In Texas, only the state and cities can set noise limits, not counties or unincorporated areas where many new AI data centers have been built (or will be built in the future).

In Hood County, near Fort Worth, neighbors of a MARA Holdings Bitcoin mining data center near Granbury tried to incorporate the community of Mitchell Bend as a city so it could pass its own noise rules. In November 2025, voters rejected the plan, with 62% of 138 ballots cast against it. Residents say the hum from the site’s cooling fans has continued.

In May 2026, nine Granbury residents sued MARA in the U.S. District Court for the Northern District of Texas, alleging private nuisance, negligence, and intentional infliction of emotional distress. MARA disputes the claims and says independent sound studies show the facility operates below legal noise limits.

Legal Help for Homeowners Near Data Centers

Dallas and Fort Worth together form one of the largest data center markets in the world, and development is pushing into the rural counties. Many of these data centers are built on former ranchland where machine-generated industrial noise can travel long distances across the open countryside.

Tech companies are now pledging billions of dollars to win over host communities, according to the Los Angeles Times. The money goes to towns, schools, and programs, but not to directly compensating property owners.

What Can I Do?

If you own property near a data center and the noise, hum, vibration, or light has lowered the value of your land, residence, or made it harder to sell, you may be entitled to compensation. Time limits apply, and our Texas lawyers can review your appraisals, listing history, and noise records to help you understand your options.
