July 30, 2024 — The second trial involving a baby who developed Necrotizing Enterocolitis (NEC) from infant formula has ended in a $495 million jury verdict.
The jury ordered Abbott Laboratories to pay $400 million in punitive damages and $95 million in compensatory damages to the family of Robynn Davis, an infant who was fed Similac Special Care 24 Infant Formula.
Lawyers argued that Abbott failed to warn hospitals about an increased risk of NEC when premature infants were fed cow’s milk-based infant formula rather than human breastmilk.
The infant was diagnosed with NEC within 72 hours of being fed Similac Special Care 24 in the Neonatal Intensive Care Unit (NICU).
The life-threatening condition resulted in a severe intestinal infection. She had to have 75% of her intestines removed, suffered brain damage, must use a wheelchair, and suffered other health problems.
There are now thousands of similar NEC lawsuits pending in courtrooms nationwide in the U.S. on behalf of premature infants who were fed Similac or Enfamil Infant Formula in the hospital.
Earlier this year, the first NEC lawsuit to go to trial ended in a jury awarding $60 million to the family of a baby who was fed Enfamil.
The lawsuit was filed in the 22nd Judicial Circuit of Missouri — In RE: Gill v. Abbott — Case Number 2322-CC01251.
