Roundup Lawsuit Filed by Home Gardener With Cancer

September 14, 2016 — A lawsuit has been filed by a home gardener who used the weed-killer Roundup and was diagnosed with non-Hodgkin lymphoma.

The lawsuit was filed by Anthony Harris, a man from San Diego, California. He used Roundup “extensively” in his home garden from 2008-2010.

He was diagnosed with cancer in January 2015 and has had over 20 rounds of chemotherapy and stem cell replacement. According to the lawsuit (PDF):

“Roundup and/or glyphosate is defective, dangerous to human health, unfit and unsuitable to be marketed and sold in commerce, and lacked proper warnings and directions as to the dangers associated with its use.”

Monsanto is facing dozens of Roundup lawsuits involving agricultural workers, farmers, or professional landscapers. A growing number of cases involve home gardeners. One recent lawsuit involves a woman who used a backpack to spray Roundup on her one-acre property.

The number of lawsuits has grown substantially since glyphosate, the active ingredient in Roundup, was declared a “probable human carcinogen” by the International Agency for Research on Cancer (IARC).

Those conclusions were based on several studies linking Roundup with non-Hodgkin lymphoma, which is a cancer that starts in the body’s immune system. One study estimated a 60% increased risk based on data from three large studies of American farmworkers.

The lawsuit was filed on September 8 in the U.S. District Court for the Southern District of California — Case No. 3:16-cv-02275.
