Ozone 500 Kids Bike Injury Lawsuit Filed in Texas

July 5, 2023 — A mother from Texas whose finger was broken by the spring on an Ozone 500 bicycle has filed a lawsuit against Academy Sports.

The lawsuit was filed by Alfreda W., a mother who purchased an Ozone 500 bicycle for her daughter in May 2021.

A few weeks later, her daughter was riding the bicycle when the seat suddenly collapsed onto the rear tire. Her husband held the bike while she tried to fix it.

Unfortunately, when she tugged on the rear shock spring, it released and crushed her middle finger.

She suffered an avulsion fracture, which is a type of fracture that occurs when a small chunk of bone is broken off internally.

Just 11 days after her injury, a recall was announced for about 3,800 Ozone 500® Girls’ and Boys’ Elevate 24-Inch Bicycles. According to the recall: “The rear shock spring on the bicycles can become stuck, creating a pinch point between the spring and the seat.”

In her lawsuit, she accuses Academy Sports of manufacturing and selling bicycles that are defective due to the dangerous “pinch point.”

Her lawsuit was filed on June 29, 2023 in the U.S. District Court for Harris County, Texas — Case Number 2023-40074.
