April 16, 2014 — There are nearly 50,000 vaginal mesh lawsuits pending in the federal court system, according to a list (.pdf) of pending MDLs by district published by the U.S. Judicial Panel on Multidistrict Litigation (JPML).

- MDL 2325 — American Medical Systems (16,515 cases)
- MDL 2326 — Boston Scientific (9,776 cases)
- MDL 2327 — Ethicon Inc. (14,679 cases)
- MDL 2387 — Coloplast Corp. (1,267 cases)
- MDL 2440 — Cook Medical (173 cases)
- MDL 2511 — Neomedic (25 cases)
The cases have been centralized before Judge Joseph R. Goodwin in the U.S. District Court for the Southern District of West Virginia. A series of so-called “bellwether trials” are scheduled to begin in the next few months, and dozens of cases are being prepared for trial.
Johnson & Johnson won the first bellwether trial in February after five days. Lawyers will be carefully watching the rest of the trials — the jury’s decision will help place valuation on the cases and hopefully help settle thousands of other cases without requiring a trial.
Earlier this month, a Texas jury awarded $1.2 million in compensation to Linda Batiste, a woman who was injured by the Ethicon TVT-O transvaginal mesh. The jury found that the product was defective, but they did not find Ethicon liable for failing to warn about its dangers.
