October 20, 2015 — A growing number of law firms in the United States are gathering plaintiffs for what could be a “mass tort” litigation against Monsanto, maker of the potentially carcinogenic weed-killer Roundup.
The latest lawsuit was filed on October 14 in Delaware Superior Court by three law firms representing three plaintiffs. The case is similar to others filed last month in New York (Fitzgerald v. Monsanto) and California (Enrique Rubio v. Monsanto).
Two plaintiffs from Texas were diagnosed with non-Hodgkin lymphoma. One plaintiff is 24 year-old Joselin Barrera, a child of migrant farm-workers. The second plaintiff, Elias de Garza, is a farmworker and landscaper.
The third plaintiff, Judi Fitzgerald, was diagnosed with chronic lymphocytic leukemia (CLL) after working as a horticulturalist in New York in the 1990s. She joined the Delaware case after asking for dismissal of a lawsuit previously filed in New York.
Reuters reports that the lawsuit accuses Monsanto of leading “a prolonged campaign of misinformation to convince government agencies, farmers and the general population that Roundup was safe.”
The litigation has been growing steadily since an agency of the World Health Organization (WHO) declared in March that Roundup was “probably carcinogenic to humans.” The report cited a number of studies linking Roundup and non-Hodgkin lymphoma and leukemia, especially among farm-workers.
