November 9, 2012 — Thousands of people have filed metal hip implant lawsuits in the last few years, amid several high-profile recalls and studies linking metal-on-metal hip implants to high rates of failure and side effects.
Most of these lawsuits have been centralized in federal litigation.
Currently, the following hip implant manufacturers are involved in litigation for injuries linked to their devices:
- DePuy Pinnacle: U.S. District Court for the Northern District of Texas
- DePuy ASR: U.S. District Court for the Northern District of Ohio
- Stryker Rejuvenate / ABG II: These hip implants have been recalled and lawsuits have been filed, but the lawsuits have not yet been centralized in a federal litigation
- Biomet M2A Magnum: U.S. District Court for the Northern District of Indiana
- Zimmer Durom Acetabular Cup: U.S. District Court for New Jersey
- Wright Conserve: U.S. District Court for Northern District of Georgia
Several types of metal-on-metal hip implants have been recalled after being linked to a high risk of severe side effects. When the metal parts grind together, tiny particles of chromium and cobalt may shed into nearby tissues. This metal debris can form an irritating residue around the hip joint, increasing the risk of pain, inflammation, swelling, tissue death, bone loss, pseudo-tumors (non-cancerous soft-tissue growths), and other side effects. Patients may also suffer high rates of chromium and cobalt in their bloodstream, which can cause metallosis (metal poisoning).
In severe cases, some patients may require revision surgery to remove the defective hip implant and replace it with another hip implant. This type of surgery can be very painful, traumatic on fragile bones, and debilitating for the patient.
Many people are seeking justice for their injuries by filing a lawsuit against the manufacturers. In most cases, the litigation is currently underway. Patients who have been injured by a metal-on-metal hip implant may still have time to file a lawsuit.
In some cases, the litigation is in the settlement phase, and the manufacturer has agreed to pay compensation to people who were injured. Zimmer Holdings, the company that temporarily recalled the Zimmer Durom metal hip implant in 2008, has recently announced that they will pay an estimated $388 million in legal costs. After Zimmer recalled the hip implant due to high rates of revision surgery, they found that the problem was with improper implantation techniques. The company has already paid $98 million to resolve Durom hip implant injury claims.
