February 8, 2021 — A lawsuit has been filed by the family of a motorcycle driver who died after drinking alcohol at Club Level in Lubbock, Texas.

The dram shop lawsuit was filed by the family of Robert M., a man who lawyers said was over-served alcohol at Club Level (also known as Level Nightclub) at 1928 Buddy Holly Ave.

Another 55-year-old man who was also involved in the accident was indicted for failing to stop and render aid.

Under Dram Shop Laws in Texas, lawsuits can be filed against bars and their owners for over-serving intoxicated persons. The lawsuit is seeking at least $1 million for negligence and wrongful death.

Back in April 2020, Level Nightclub permanently lost its liquor license after a deadly shooting left two people dead on New Year’s Day, following an investigation by the Texas Alcoholic Beverage Commission.
