February 1, 2019 — A woman who was permanently injured and disfigured by a vaginal mesh implant has been awarded $41 million by a jury in Pennsylvania.
The vaginal mesh lawsuit was filed by Suzanne Emmett against Ethicon, a subsidiary of Johnson & Johnson.
Emmett began experiencing serious problems soon after her vaginal mesh was implanted in May 2007. It repeatedly eroded through the soft tissues into her vagina, causing significant discomfort, bleeding, infections, pain during sex, and other devastating complications.
She suffered through 9 corrective surgeries and nearly a dozen chemical cauterizations in an attempt to fix problems that occurred after 14 mesh erosions.
Her lawsuit accuses Johnson & Johnson of selling a defective and unreasonably dangerous medical device, failing to adequately warn her about the risk of erosions and other side effects, and intentionally concealing the high failure rate associated with vaginal mesh implants.
Johnson & Johnson has now been hit with over $145 million in jury verdicts from multiple trials in Pennsylvania, with another 90 cases pending in that court. An additional 37,400 federal vaginal mesh injury lawsuits have also been filed in federal court in West Virginia.
The lawsuit is In RE: Suzanne Emmet et al. v. Ethicon Inc. et al. — Case No. 130701495 before the Court of Common Pleas of Philadelphia County, Pennsylvania.
