Jury Awards $27 Million in Pinnacle Vaginal Mesh Trial

November 14, 2014 — A federal jury in Miami, Florida has awarded $27 million to four women who were injured by vaginal mesh products made by Boston Scientific Corp.

Law360 reports that the jury awarded $6.53 million to Mania Nunez, $6.72 million each to Juana Betancourt and Amal Eghnayem, and $6.76 million to Margarita M. Dotres. No punitive damages were awarded.

Lawyers for the women claim Boston Scientific rushed the Pinnacle implant to market without conducting adequate safety tests. The women were injured by infection, scar tissue, organ perforation, chronic pain, and more. The lawsuits were originally filed in West Virginia, but transferred to Florida last month.

Last week, another trial against Boston Scientific began in West Virginia. In July 2014, Boston Scientific won the first trial involving the Pinnacle. However, in September, they were hit with a $34.6 million loss when a jury in Texas found that the Obtryx sling was defective.

The Pinnacle is used to treat pelvic organ prolapse, a condition in which abdominal organs push into the vagina. The sling-like implant that is designed to support the pelvic floor. Instead, thousands of women have been injured when the mesh eroded. In many cases, surgery cannot completely remove the mesh or correct complications.

In recent months, several manufacturers have agreed to settle hundreds of lawsuits. In October, C.R. Bard settled 500 lawsuits for $21 million, or about $43,000 per claim, and Endo International settled about 10,000 lawsuits for about $48,000 per claim. Many of these settlements are structured so that women with more severe injuries, or those who need surgery in the future, are eligible for more compensation.
