September 30, 2015 — Monsanto Co. has been hit with a lawsuit (PDF) from a woman who blames the weed-killer Roundup for causing her cancer.
The lawsuit was filed by Judi Fitzgerald in the U.S. District Court for the Eastern District of New York (Case No. 2:15-cv-05494) on September 22.
Ms. Fitzgerald is a resident of Virginia who was exposed to Roundup in St. James, New York from around 1994-1998. She was employed at N & O Horticultural Products and was responsible for growing plants and vegetables in the nursery and fields. According to the lawsuit:
“She recalls the vapors of Roundup inside the building and the wind drifts of Roundup outside when applied. … On at least several occasions, Ms. Fitzgerald became ill within hours of being in the vicinity of the spraying of Roundup.”
Ms. Fitzgerald was diagnosed with chronic lymphocytic leukemia (CLL) in October 2012. After her diagnosis, she was unable to work and forced to move from Long Island to Virginia for economic reasons.
She did not learn about the link between Roundup and leukemia until March 2015, when an agency of the World Health Organization (WHO) declared Roundup a “probable human carcinogen.” Monsanto is accused of selling a defective product that is “unreasonably dangerous” and was never sufficiently tested before it was marketed as safe.
Cancers most associated with Roundup are non-Hodgkin lymphoma and other haematopoietic cancers, including lymphocytic lymphoma/chronic lymphocytic leukemia, B-cell lymphoma, and multiple myeloma.
