October 1, 2014 — Bloomberg reports that Endo International Plc. has agreed to pay at least $400 million to resolve “substantially all” lawsuits involving their vaginal mesh implants.
The agreement settles more than 10,000 lawsuits for an average payment of $48,000 per plaintiff. All of the lawsuits involve vaginal mesh products from American Medical Systems, including the Perigee, Apogee, and Elevate mesh implants.
In total, Endo has agreed to pay nearly $1.3 billion to resolve lawsuits involving the mesh. Earlier this year, the company agreed to pay $830 million to settle 20,000 lawsuits — announcing the settlement just one day after the FDA said vaginal mesh implants should be subject to stricter safety requirements because they are high-risk devices. In June 2013, Endo paid $54.4 million to resolve an undisclosed number of cases.
According to Bloomberg, Endo still faces about 5,000 lawsuits.
None of the lawsuits against Endo have gone to trial. The first trial is set for early 2015 in state court in Texas. Last month, a Dallas jury returned a $73 million verdict in factor of a woman who was seriously injured by Boston Scientific’s Obtryx vaginal mesh product. A few weeks earlier, a West Virginia jury awarded $3.27 million to a woman who was injured by Johnson & Johnson’s TVT-O mesh implant.
Most plaintiffs in the litigation are women who were severely injured when the mesh eroded into their body. In July 2011, the FDA warned that serious complications were not rare. Since then, thousands of women have come forward to seek compensation for complications like chronic pain, recurrent incontinence or prolapse, nerve damage, disfigurement, and revision surgery.
