$7.5 Million Benzene Lawsuit Settlement in Las Vegas

In October 2011, a jury in Las Vegas awarded $7.5 million to the family of a Nevada truck driver who died of cancer in 2009 after years of breathing benzene fumes in gasoline.

The lawsuit was filed on behalf of Rick Lewis, a man who was diagnosed with Myelodysplastic Syndrome (MDS) after working as a tanker-truck driver from 2002 to 2008.

Every day, Lewis loaded his truck with gasoline and delivered it to other locations. The gasoline contained up to 3% benzene, a carcinogen that is associated with MDS and other types of cancer.

The jury in Clark County District Court determined that his employer, Kinder Morgan Energy Partners L.P., failed to protect employees or warn them about the risk of cancer from breathing benzene in gasoline fumes.

What is the problem?

Benzene chemical exposure is known to cause several types of leukemia. Unfortunately, benzene is widely used in solvents, degreasers, paint, gasoline, diesel fuel, oil, and many other products, but very few carry warnings about cancer. Workers — especially mechanics and railroad workers — have a high risk of exposure.

Benzene is a sweet-smelling, highly-flammable toxic chemical that evaporates very quickly into the air. There is no “safe” level of exposure to benzene — it is known to cause health problems at even low levels.

Over time, workers can accumulate high levels of benzene in their bones as a result of breathing benzene in the air or absorbing it through the skin. This is why benzene is associated with leukemia, lymphoma, and blood cancers due to bones making abnormal cells.
