October 29, 2015 — The Star-Tribune reports that Boston Scientific has reached settlement agreements with 6,000 women suing the company for injuries caused by vaginal mesh implants.
The company will pay $457 million in settlements, but did not explain how individual plaintiffs would be compensated. If the settlement were divided equally, each plaintiff would receive about $75,000. In April, Boston Scientific paid about $40,000 per case to settle a group of 3,000 lawsuits.
The company has been steadily winnowing down about 30,000 lawsuits involving vaginal mesh products. About 18,000 of those cases are pending in a centralized federal litigation in West Virginia. Several other manufacturers are facing another 50,000 vaginal mesh lawsuits.
Settlements have been progressing steadily after Boston Scientific was hit with several eye-popping jury verdicts in favor of women who were injured by vaginal mesh. In May 2015, a jury in Delaware awarded $100 million to a woman who was injured by the Pinnacle and Advantage Fit implants.
The amount included $75 million in punitive damages and $25 million in compensation. However, it was slashed to $10 million after a judge found the award “grossly disproportionate to the injuries suffered.”
Law360 also reports that Boston Scientific has agreed to pay $34.5 million to a woman from Texas who was injured by the company’s Obtryx vaginal mesh. The woman, Martha Salazar, won a $73 million jury verdict last year, including $50 million in punitive damages, but the amount was reduced by the trial court in its final judgment.
